Brody Berman has worked with scores of businesses in a wide range of industry sectors to help them explain the meaning of their innovation rights and other intangibles, and to reach business goals more efficiently. Sample clients and assignments include:
IP Brand Awareness: Confidential Survey. BBA conducted a confidential survey for an information technology company to determine how key audiences regard its IP performance and value. The client used the information to improve perception, plan a licensing strategy and avoid litigation.
IP Services: Business Development. BBA assisted several different software and IP support companies in successfully reaching and influencing senior decision-makers about their products. In conjunction with this assignment BBA provided business development support (key introductions) and media relations strategy and implementation.
Management Consulting: Competitive Benchmarking. Assisted a world class management consulting firm in determining who among its top competitors is engaged in IP strategy assignments for operating companies; what is the nature of the projects; and are they sufficiently profitable and financially viable?
Mobile Communications: IP Brand Development. BBA helped a Global 500 company understand how its defensive patents and licensing activities are seen, by whom and why? Also, we made a formal presentation to determine what ways to correct possibly inaccurate impressions.
Patent Aggregation: Media Relations. Assisted a defensive patent aggregator in managing its member/stakeholder relations, including assuring the accuracy of a “leaked” story about the organization to run on page one of a business publication.
Patent Licensing: Client Awareness. For a law firm’s client, initiated, organized and secured through BBA’s network an accurate article about a patent licensing and enforcement program for LCDs. We assured that it was accurately reported and depicted in the business and technology press, as well on several social networking sites.
Pharma-Life Sciences: Litigation Support. When a Fortune 500 pharmaceutical makers lost a patent dispute involving over $1 billion in damages BBA was asked to position the business and issues involving the Court of Appeals for the Federal Circuit appeal, and to identify potential resources for reporters most likely to write follow-up stories.
Semiconductors: Reputation Management. Assisted a privately held, strained silicon chip designer in building a reputation for effective R&D, patent quality and licensing success. We employed BBA contacts and media relations. This activity led to major licenses and additional capital formation.
Special Situation: Bankruptcy. BBA managed investor relations for then insolvent Marvel Entertainment. We worked with management and legal teams recruited by bond holder Carl Icahn. We also worked with the DIP lender. Our primary objective was to help maintain viability of Marvel IP assets (characters like Hulk®, Spiderman®, etc.) in the financial community. Marvel emerged from bankruptcy and was eventually sold to Disney for $4 billion. |
